Vendor Terms & Conditions

Section I. GENERAL TERMS

SUBLETTING BOOTHS: Vendors may not sublet or loan their space(s). All vendors must have a Vendor Profile Form and Registration form for each event on file with Lowcountry Vendor Events.

Exclusivity will not be granted to any one vendor; however, precautions will be taken to limit duplication of similar items. Sales will be restricted to those items listed on your approved application. You will be notified prior to acceptance if any of your listed items are required to be removed from your item list.

Vendors selling items that were not approved on the application may be subject to one or more of the following: Removal of the unapproved item(s) or expulsion from the event without refund.

SALES TAX: Vendors are responsible for collecting and reporting their own sales tax.

SALES: All sales and displays must be confined within the booth space. No hawking.

CANOPIES must fit within booth space and be constructed to withstand inclement weather conditions.

CANOPIES must be weighted on all four corners. (You are responsible for any and all damages caused by your canopy)

SECURITY: Although security may be provided at the event, Vendors are fully responsible for their own personal property. Neither Lowcountry Vendor Events nor the event will assume liability for any losses that you may incur.

Photos or video including sound, may be taken at this event of you, your booth, and or your products or works and used to promote this and future events by Lowcountry Vendor Events, its affiliates, and other advertising entities.

Section II. CANCELLATION TERMS

Booth Fees are non‐refundable, with the exception of the approved cancellation policy.

There will be no refunds for failure to show, illness, inclement weather, or any other reason not listed below.

If you provide the event coordinator with a 7+ day notice, you will be provided a refund of 75% of all vendor fees paid.

If you provide the event coordinator with a notice of less than 7 days, you will be provided a future event credit. No refund of vendor fees will be issued. (credit must be used within 3 months of being issued).

If you provide the event coordinator with a notice the day of the event, no refund and no credit will be issued for any reason.

Lowcountry Vendor Events may change or adjust the hours or days of the event due to forces of nature, or other occurrences beyond our reasonable control. Such changes will not be considered a breach of this agreement and will not constitute grounds for a refund. If Lowcountry Vendor Events for any reason, deems cancellation of the event necessary, a future event credit will be issued to all vendors and must be used within 6 months of being issued.

Section III. LICENSING, PERMITS, & INSPECTIONS

VENDORS MUST COMPLY WITH ALL FEDERAL, STATE, COUNTY AND CITY LICENSE AND PERMIT REQUIREMENTS: Vendors are responsible for charging and remitting all sales and other taxes (unless exempt from taxation) and complying with all federal, state, and local laws and ordinances.

Vendors are required to obtain and maintain any licensing required by the County of Beaufort or State of South Carolina. Vendors are solely responsible for knowing when licesnes, permits, or inspections are required and ensuring that they are compliant with the county and state that the event is being held. Lowcountry Vendor Events shall not be held liable for any vendor that is cited by the County or State for not having the necessary documentation required to be a vendor at any of our events.

Section IV. ON-SITE PROCEDURES

VENDOR LOAD-IN: Vendors are required to arrive at 8:00am on each day of the event. Vendors are to check-in with the event staff, receive their booth assignment, and then immediately unload their vehicle. Vehicles must be removed from the event space before setup of the booth begins. This is to ensure that all vehicles are not impeding other vendors from setting up. Once the vehicle is unloaded and removed from the vending space, vendors are permitted to begin setting up their tent, tables, and products.

VENDOR’S GARBAGE AND CLEANUP: Vendors are responsible for cleanup of their area. All garbage should be placed in trash receptacles provided by Lowcountry Vendor Events; boxes must be broken down and flattened in preparation for recycling. Nothing is to be left in your booth when you leave. Anything left is considered trash. 

There will be a cleaning fee imposed for those that do not clean up their booth. If the cleaning fee is not paid then the vendor will NOT be permitted to vend at any future event with Lowcountry Vendor Events.

VENDOR LOAD-OUT: Vendors are not permitted to leave early without approval from the event staff. The ONLY reasons for leaving early shall be for emergencies or product sell-out. Any vendor that leaves without approval from staff shall be banned from all future events.

At 4:00pm, all vendors will be permitted to begin tearing down their booth space. Vehicles will be permitted to be brought into the vending space in an orderly fashion.

BARRIERS AND PARKING: Barriers shall not be moved by any vendor for any reason. Event staff will do everything possible to ensure that vendors are allowed to park near their booth space. Vendors are alotted one parking space per 10ft space that they have rented. If a vendor has multiple vehicles present for the event, only one will be alotted space near their booth and the additional vehicles may have to park elsewhere.

Section V. ITEMS NOT ALLOWED

BANNED ITEMS: Banned items include, but are not limited to, the following which are not to be sold or brought to the event premises: 

a) firearms, ammunition, fireworks, dynamite, or any other explosive material, 
(b) dangerous animals, 
(c) any books or other materials that may be considered by event staff to be offensive or pornographic, 
(d) counterfeit, illegal, or stolen items, 
(e) drug related paraphernalia, 
(f) pepper gas or any device that could cause harm to any people 
(g) mechanisms for creating permanent tattoos. 

Management reserves the right at any time to prohibit certain additional items from being sold, traded, displayed in any manner, or given away. No animals of any kind may be sold as pets. 

No alcoholic beverages are allowed unless prior approval is granted by the event staff and venue management team.

ABUSIVE OR OBSCENE LANGUAGE OR ACTIONS: Use of obscene language or actions or physical violence is strictly prohibited and is grounds for immediate expulsion from the event and forfeiture of all rental fees.

ILLEGAL ACTIVITIES: No vendor or representative shall conduct any illegal activity, sell merchandise illegal to possess, or act in any illegal manner on the premises of the event.

Section VI. ADDITIONAL CLAUSES

TERMINATION: Management reserves the right to terminate at any time the lease of any vendor for any reason.

RULES AND REGULATIONS are subject to change without notice.

Section VII. ADDITIONAL REQUIREMENTS FOR FOOD VENDORS

It is MANDATORY that ALL FOOD VENDORS have adequate fire extinguishing equipment at their booth with current certification tags attached and ready for inspection by the Fire Marshal, this includes a Class K extinguisher if fryers are used.

Mobile Vending License or Department of Health and Environmental Control Permit:

Lowcountry Vendor Events does not require this information. Vendors must be prepared to pass health inspection and pay on site with a money order if you do not have these licenses or permits in place. Food Trucks are REQUIRED to have a valid inspection with the Beaufort County Fire Marshall. Failure to have this inspection up to date could lead to penalities imposed by the Fire Marshall's office. Lowcountry Vendor Events is not repsonsible for any penalities imposed due to lack of paperwork or inspection completion.

Work Area: All Food Vendors who are cooking on site are required to cover the area under your workspace to protect the cleanliness of our venues. You will not be allowed to open if you do not comply with this condition, nor will you receive a refund or credit.

All cooking oil must be properly disposed of. The event does not provide a disposal container. Cooking oil may not be disposed of in the trash or through any other means. Food Vendors will be required to have and always maintain oil/grease protection barriers within their booth. All propane deep fat fryers must be self‐contained (enclosure of open flame) and be controlled by an accurate thermostat (if applicable).
